These Terms and Conditions set out the basis on which Gardeners Harrow on the Hill provides gardening and related services in the United Kingdom. By making a booking, accepting a quotation, or allowing our gardeners to commence work at your property, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the person, company or organisation requesting the services.

Company means Gardeners Harrow on the Hill, including its employees, contractors and authorised representatives.

Services means gardening, garden maintenance, planting, lawn care, hedge cutting, pruning, garden clearance, soft landscaping and any other related services provided by the Company.

Property means the outdoor space, garden or grounds where the Services are to be carried out.

Agreement means the contract between the Client and the Company incorporating these Terms and Conditions and any written quotation.

2. Scope of Services

The Company provides domestic and commercial gardening services within its defined service area. The exact scope of work, including tasks to be carried out, estimated time required, and any specific requirements, will be agreed with the Client before work begins, usually via quotation or confirmation message.

Any descriptions of Services provided verbally are for guidance only. Only what is written and agreed in the quotation, booking confirmation, or subsequent written variations forms part of the Agreement.

3. Booking Process

3.1 Enquiries

Clients may request a quotation or provisional booking for gardening services. The Company may request photographs, a description of the garden, or an on-site visit to assess the work before confirming a price or appointment.

3.2 Quotations

All quotations are based on the information available at the time. Quotations may be provided as a fixed price for a defined job or as an hourly rate with an estimated duration. Quotations are valid for a limited period as stated at the time of issue or, if not stated, for 30 days from the date of issue.

3.3 Acceptance and Confirmation

A booking is only confirmed when the Company has issued written confirmation of the appointment, which may include the date, time window, pricing basis and any specific conditions. By confirming a booking, the Client agrees to these Terms and Conditions.

3.4 Access Requirements

The Client must ensure that the Company has safe and sufficient access to the Property at the agreed time, including access to any gated areas, side entrances, or communal spaces necessary to perform the Services.

4. Client Responsibilities

The Client agrees to:

Provide clear instructions regarding the garden areas to be worked on and any plants, trees, structures or features that must not be disturbed.

Inform the Company of any hazards at or near the Property, including uneven surfaces, ponds, hidden cables, pipes or other risks.

Ensure children and pets are kept away from the working area for the duration of the visit and until it is safe to re-enter.

Obtaining any necessary consents, permissions or approvals from landlords, neighbours, management companies, or local authorities before work commences, where applicable.

5. Pricing and Payment Terms

5.1 Pricing Basis

Services may be charged on a fixed-price basis for a specified job or on an hourly or day rate. Prices will be communicated to the Client in advance of work being carried out. Unless expressly stated otherwise, quotations do not include the supply of plants, materials, or disposal of green waste.

5.2 Additional Work

If, during the course of the work, it becomes apparent that additional tasks are required or requested by the Client beyond the original scope, the Company will explain any extra costs. Additional work will only be carried out with the Client’s consent, which may be provided verbally or in writing.

5.3 Payment Methods

Payment terms will be communicated at the time of booking or invoicing. The Client agrees to pay invoices by the due date specified. For one-off visits, payment is usually due on completion of the work or within a short period following the issue of an invoice. For regular maintenance, payment terms may be monthly or per visit as agreed.

5.4 Late Payments

Where payment is not received by the due date, the Company reserves the right to charge interest and reasonable administration costs for late payment, in accordance with applicable UK law. The Company may also suspend or cancel future bookings until outstanding amounts are paid in full.

6. Cancellations, Rescheduling and Access

6.1 Client Cancellations

If the Client needs to cancel or reschedule an appointment, the Client should provide as much notice as possible. The Company may apply a cancellation charge where less than 24 hours notice is given, where the Company has already incurred preparation or travel costs, or where it is not reasonably possible to fill the appointment slot.

6.2 Company Cancellations

The Company reserves the right to cancel or reschedule an appointment due to adverse weather conditions, staff illness, vehicle or equipment issues, safety concerns, or other circumstances beyond its reasonable control. The Company will seek to notify the Client as soon as reasonably practicable and to arrange an alternative appointment.

6.3 Access Issues

If, on arrival, the Company is unable to gain access to the Property, or if conditions prevent safe working, the Company may treat the visit as cancelled by the Client and a call-out or cancellation fee may be charged to cover time and travel costs. The Client is responsible for ensuring that access arrangements are in place in advance of the visit.

7. Health and Safety

The Company will take reasonable steps to ensure that the Services are performed safely and in accordance with relevant health and safety regulations. The Client agrees not to request tasks that the Company considers unsafe or inappropriate for the conditions or equipment available.

Use of power tools, ladders and machinery will be at the discretion of the Company. The Company may decline to perform certain tasks if the environment is hazardous, if weather conditions are unsuitable, or if the height, slope or surface presents unreasonable risk.

8. Gardening Materials, Plants and Products

8.1 Supply of Materials

Where plants, turf, compost, mulch, aggregates, timber, or other materials are supplied by the Company, they will be sourced from suppliers considered appropriate for the requested purpose. The Company cannot guarantee specific variations in appearance, colour, size, or growth behaviour of natural products.

8.2 Planting and Establishment

The Company will take reasonable care when planting and placing materials. After completion, responsibility for ongoing care, watering, feeding and protection of plants rests with the Client, unless otherwise agreed as part of a regular maintenance service.

8.3 Use of Chemicals

Where weed control, fertilisers or other garden chemicals are used, they will be used in accordance with manufacturer guidance and applicable regulations. The Client will be advised where areas should be avoided by children and pets for a defined period. The Client is responsible for following such guidance after the Company leaves the Property.

9. Waste Handling and Garden Clearance

9.1 Green Waste

The default arrangement is that green waste (such as grass cuttings, prunings and leaves) is left on site in an agreed location, compost area, or in the Client’s garden waste bins, unless removal has been specifically included in the quotation.

9.2 Waste Removal Services

If the Client requests removal of green waste, an additional charge may apply to cover handling, transport and disposal fees. The Company will comply with UK waste regulations when transporting and disposing of garden waste, including the use of appropriate licensed facilities.

9.3 Non-Green Waste

Rubbish that is not green waste, such as old furniture, plastics, metals or construction debris, is not normally included in garden clearance unless explicitly agreed. Where removal of such items is agreed, separate charges and conditions may apply. Certain hazardous or restricted materials cannot be removed by the Company.

10. Property Condition and Damage

The Company will take reasonable care to avoid damage to the Property while carrying out the Services. However, gardening work inherently involves the use of tools and machinery in outdoor environments, and minor disturbances to soil, lawns, borders or surfaces may occur.

The Client should notify the Company of any underground cables, pipes, irrigation systems, or other hidden infrastructure before work begins. The Company cannot accept liability for damage to items that were not brought to its attention or were not reasonably apparent.

Any concerns about damage or condition of the garden following a visit should be reported to the Company as soon as reasonably possible and, in any event, within 7 days of the work being carried out, so that the Company can review the matter.

11. Liability and Limitations

11.1 General Liability

The Company will exercise reasonable skill and care in providing the Services. If the Company is found liable for any loss or damage suffered by the Client arising from the Services, such liability will be limited to the value of the relevant job or, where part of a series of visits, the value of the visit during which the incident occurred, except where otherwise required by law.

11.2 Exclusions

The Company will not be liable for:

Loss or damage arising from information provided by the Client that is incomplete, inaccurate or misleading.

Loss or damage arising from the Client’s failure to follow aftercare recommendations, maintenance guidance, or safety instructions.

Indirect or consequential loss, such as loss of enjoyment, loss of business, or loss of profits, to the fullest extent permitted by law.

Loss or damage caused by extreme weather, pests, diseases, acts of nature or events outside the Company’s reasonable control.

11.3 Personal Property

The Client is responsible for removing or protecting any garden ornaments, outdoor furniture, decorative items and personal belongings that may be at risk during the work. The Company will not be liable for accidental damage to such items where reasonable care has been taken.

12. Insurance

The Company maintains appropriate insurance cover for its gardening operations, including public liability insurance, in accordance with UK industry practice. Evidence of insurance can be provided upon reasonable request.

13. Complaints and Service Issues

If the Client is dissatisfied with any aspect of the Services, the Client should contact the Company promptly with details of the concern. The Company will investigate the matter and seek to find a fair and reasonable resolution, which may include returning to the Property to review the work, rectifying issues where appropriate, or offering a partial adjustment where justified.

14. Force Majeure

The Company will not be liable for any failure or delay in performing its obligations where that failure or delay results from causes beyond its reasonable control. This may include severe weather conditions, flooding, storms, fire, epidemics, strikes, transport disruptions, or other unforeseen events. In such cases, appointments may be rescheduled or, where necessary, cancelled without liability for resulting losses.

15. Changes to Terms and Conditions

The Company may update or amend these Terms and Conditions from time to time. The latest version will apply to new bookings made after the date of the change. For ongoing maintenance arrangements, the Company will notify the Client of any material changes that affect the Agreement.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any Agreement between the Client and the Company, are governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising out of or in connection with the Services or these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Client and the Company in relation to the Services. No other statements, promises, or representations, whether oral or written, shall be binding unless expressly incorporated in writing.

By confirming a booking or allowing the Company to commence work at the Property, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
